1. Acceptance of Terms

By accessing and using TixLayer (tixlayer.com, “the Platform”), you agree to be bound by these Terms of Service (“Terms”). The Platform is operated by Samio Technology Ltd, trading as TixLayer (“TixLayer”, “we”, “us”), a company registered in England and Wales under company number 16407750, with its registered office at Felden, Brentor, Devon, PL19 0LR, United Kingdom. If you do not agree to these Terms, please do not use the Platform.

These Terms apply to all visitors, users, and customers of the Platform. We may update these Terms from time to time. If we make material changes, we will notify you by posting a notice on the Platform or, where appropriate, by email. Changes do not apply retroactively: bookings are governed by the version of these Terms in force at the time the booking was made.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a booking on TixLayer. If you are booking on behalf of others, including minors, you confirm that you have the authority to do so and that all persons in the booking accept these Terms.

3. Our Service

TixLayer is an online marketplace for tours, activities, and experiences. We act as an intermediary between you (the customer) and third-party activity operators (the suppliers). When you make a booking through TixLayer:

  • Your contract for the activity itself is with the supplier, not TixLayer
  • TixLayer facilitates the booking and payment process
  • The supplier is responsible for delivering the activity as described
  • TixLayer provides customer support and manages the booking lifecycle

We do not own, operate, or control the activities listed on our Platform. We make reasonable efforts to ensure listing accuracy, but we cannot guarantee that all information provided by suppliers is complete or up to date. The supplier's own terms and conditions may also apply to your activity; where they do, they are available from the supplier or noted on the activity page or your voucher.

Our Platform includes an AI-powered chat assistant to help answer questions about activities and bookings. While we work to keep it accurate, the assistant may occasionally provide incomplete or incorrect information. Your booking confirmation email and voucher are the authoritative record of your booking; nothing said by the chat assistant modifies these Terms or your booking.

4. Account Registration

You may use TixLayer as a guest or create a registered account. If you create an account:

  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorised use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

Guest checkout is available for one-off bookings without creating an account.

5. Booking Process

When you make a booking on TixLayer:

  1. You select an activity, date, time (if applicable), and number of guests
  2. You review the total price including any applicable service fees
  3. You provide your contact details and payment information
  4. Your booking is confirmed once payment is successfully processed
  5. You receive a confirmation email with your booking reference and voucher

A booking is binding once confirmed. Please check all details carefully before completing your purchase.

Pricing errors: If an activity is listed at an obviously incorrect price due to a technical or clerical error, we may cancel the booking and issue a full refund, even after confirmation. We will notify you as soon as reasonably possible if this happens.

6. Pricing and Payments

All prices displayed on TixLayer include applicable taxes unless stated otherwise. You can browse and pay in your preferred currency using the currency selector. Where your chosen currency differs from the supplier's local currency, prices are converted using our exchange rates, which are updated regularly and may include a currency conversion margin. The total you see at checkout is the total you will be charged.

Service fee: A service fee may be added to your booking. This fee covers TixLayer's operational costs and is clearly displayed before you complete your purchase.

Payment methods: We accept credit cards, debit cards, Apple Pay, and Google Pay, processed securely through Stripe. TixLayer does not store your full card details.

Promo codes: Promotional codes may be subject to additional conditions including minimum spend requirements, validity periods, and usage limits. Promo codes cannot be combined unless explicitly stated. We reserve the right to void bookings that abuse promotional offers.

7. Cancellation and Refunds

Cancellation policies vary by activity and are displayed on the activity page and during checkout. Common policies include:

  • Free cancellation: Cancel before the stated cutoff time for a full refund
  • Non-refundable: No refund is available after booking
  • Partial refund: Some activities offer partial refunds depending on when you cancel

To cancel a booking, use the cancellation option on your booking page or contact our support team. Refunds are processed to the original payment method and typically take 5–10 business days to appear on your statement.

Supplier cancellations: If the supplier cancels your activity, you are entitled to a full refund. Where possible, we will also offer you an alternative date or a comparable activity as an option — but the choice is yours.

Statutory cooling-off period: Under the Consumer Contracts Regulations 2013 (and equivalent EU rules), the 14-day right to cancel online purchases does not apply to leisure activities scheduled for a specific date or period. Your cancellation rights for each booking are as set out in the activity's cancellation policy shown at checkout.

8. Vouchers and Attendance

  • Present your voucher (printed or on your phone, as specified on the voucher) at the activity, together with any identification the supplier requires
  • Vouchers are valid only for the activity, date, time, and guests stated on them and are not transferable unless the activity page says otherwise
  • Arrive at the meeting point by the stated time; late arrival or failure to attend (“no-show”) is treated as a cancellation by you and is not refundable unless the activity's cancellation policy says otherwise
  • The supplier may refuse entry without refund if you do not meet stated requirements for the activity (for example age, health, or safety requirements disclosed on the activity page)

9. Reviews and User Content

After your visit, you may submit a review of the activity, including a rating, text, and photos (“User Content”). By submitting User Content you grant TixLayer a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and translate it on the Platform and in our marketing, together with the display name and country you provide. You retain ownership of your User Content.

User Content must be based on your genuine experience and must not be unlawful, defamatory, offensive, misleading, or infringe anyone else's rights. We may moderate, edit for formatting, decline to publish, or remove User Content at our discretion. You can request removal of your own review at any time by contacting us.

10. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful or fraudulent purpose, including making bookings with stolen payment details
  • Resell vouchers or bookings commercially without our written agreement
  • Use bots, scrapers, or other automated means to access the Platform or extract its content
  • Interfere with the Platform's security or attempt to gain unauthorised access to our systems or other users' accounts
  • Misuse the chat assistant, promotional offers, or the review system

We may suspend access, cancel bookings, or terminate accounts involved in any of the above.

11. Intellectual Property

All content on the Platform — including text, images, logos, and software — is the property of TixLayer or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

12. Limitation of Liability

To the fullest extent permitted by law:

  • TixLayer is not liable for the quality, safety, or suitability of activities provided by suppliers
  • We do not guarantee that activities will meet your expectations
  • Our total liability for any claim arising from your use of the Platform is limited to the amount you paid for the relevant booking
  • We are not liable for indirect, incidental, or consequential damages

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or affects your statutory rights as a consumer, which cannot be excluded or limited by these Terms.

13. Events Beyond Our Control

Neither TixLayer nor the supplier is liable for failure or delay in performing obligations caused by events beyond reasonable control, including extreme weather, natural disasters, epidemics, strikes, or government restrictions. If such an event prevents your activity from taking place, the supplier cancellation provisions in section 7 apply and you will be offered a full refund or an alternative.

14. Dispute Resolution

If you have a complaint about a booking, please contact us via our Help Centre or by email at [email protected]. We will aim to resolve your complaint within 14 business days.

If we cannot resolve a dispute directly, you may be able to refer the matter to a certified alternative dispute resolution (ADR) provider. We will provide details of an appropriate ADR provider on request. Nothing in this section prevents you from bringing a claim in court.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer protection regulations in your country of residence provide otherwise.

16. General

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force
  • These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and TixLayer regarding use of the Platform
  • We may transfer our rights and obligations under these Terms to another organisation (for example in a company reorganisation); this will not affect your rights
  • A failure by us to enforce any provision of these Terms is not a waiver of that provision
